| 摘 要： | 国际人权条约具有类似宪法基本权利的间接第三人效力，对成员国的国际私法有直接影响。法院在处理涉外案件时必须以本国加入的国际人权公约为标准，对适用外国法的结果进行公共秩序审查。在公共秩序保留制度中引入国际人权条约不会导致盲目排除外国法。
