高等学校人事管理自由裁量权的法治思考

摘    要:自由裁量权是高等学校人事管理中不可缺少的一种权力,它的存在是提高人事管理效率的需要,是适应人事管理复杂多变的客观实际的需要。但是,自由裁量权的固有特征使其在运行中有被滥用的可能,控制自由裁量权是法治的要求,对高等学校人事管理自由裁量权的控制包括事前控制、事中控制和事后控制。

Abstract:Discretion is an indispensable power of personnel management in colleges and universities, and its existence is the requirement of increasing efficiency of personnel management as well as the needs of complex facts. However, the nature of discretion provides the possibility for its abuse, so it is necessary to control the discretion. This paper suggests the control should cover three parts controlling beforehand, controlling in progress, and controlling afterwards.
