| Abstract: | On the basis of analysis of the basic attributes of mediation by court, the article points out that the understanding of mediation by court is caught up in an erroneous impasse. It is a key factor that is affecting the legislation of mediation by court and its practical exercise. The writer takes this point and advocates that the mediation by court cannot be rashly eliminated. Proposals for perfecting it are put forward. |
