高等教育权可诉性的理论分析与制度构建

摘    要:通过对大学自治理论,特别权力关系学说,处理私人纷争并非基本权利本质属性等阻却高等教育权可诉性的理论学说和制度障碍进行剖析;指出在人权保障及法治的理念下,应坚持法律优先与法律保留、基础性与重要性关系原则,从法律权利与宪法权利不同层面、不同程度,通过违宪审查、民事、刑事、行政等不同进路,赋予公民高等教育权可诉性,以期促进我国高等教育的健康发展。
