| 摘 要： | 民事再审程序作为一种特殊救济程序，在追求实体公正和司法本质上起着重要作用。它有着纠错、救济、保障和监督等多项功能。而我国民事再审制度存在的缺陷和不完善则严重影响生效裁判的既判力。既判力和再审的发动是一对与生俱来的矛盾，承认并采取正确的制度来平衡两者的冲突，进而完善我国民事诉讼法是我们追求的目标。

| Abstract: | As a special relief procedure,civil retrial procedure plays an important role in the substantial justness and the nature of justice.It has many functions like error correction,relief,safeguard and surveillance.However,there are some flaws in the civil retrial procedure of our country,which severely prevent res judicata.Res judicata and retrial procedure are contradictory in essence,which we must recognize so as to improve our code of civil law and achieve the balance. |
