P2P债权转让模式中的制度创新与风险监管

互联网的快速发展带动了以P2P网络借贷平台为代表的互联网金融崛起，成为了金融领域的重要构成。促进金融普惠大众的同时，也出现了许多风险，不仅给投资者造成了损失，而且也影响了行业市场环境的健康发展，甚至造成了金融秩序的混乱。然而在监管过程中，监管部门对于P2P网络借贷平台不仅存在监管方式不到位，监管规范不健全，或者滥用监管权力，干涉平台运营，甚至对于某些运营模式下的平台缺乏系统性监管手段。及时完善法律规定、设定行业准入标准、运营规范等措施外，建设市场征信系统、完善社会个人信用体系应是行业持续发展的基础。

Research on the Legal Supervision of P2P Online Lending in China

The rapid development of Internet drives the finance which springs up and becomes an important part of Internet, such as P2P Online lending platform. The public benefit from Internet finance, while on the other side, a great deal of risks are hidden in it. It not only makes investors suffer from loss, but also damages the healthy environment of the market development. What’s worse, it destroys the financial order to confuse. However, the supervision department does not fill its duty fully during the progress. On one hand, it dose worse in the mode and the standard, even its branches abuse its power to interfere the platform during the supervision. On the other hand, it lacks of a systematic supervision manner when some platforms use different ways. So it could be the basic of the industry not only when the supervision department develops the rules, such as setting a standard that it must abide when it prepares, enters and runs, but also it builds a Market Credit System and improves the Social Personal Credit System.
