| 摘 要： | 网络链接不涉及对作品的复制，一般不构成对版权的侵权，但是不同形式的链接对版权人是否造成损害及其损害程度亦会不同。因此，需要对各种情形进行具体分析，以期既能保护版权人的权利，又能维护社会利益。
