| 摘 要： | 为了证明司法裁判的正当性、解决案件实体问题、救济个案当事人,在司法裁判中必须对概括抽象的法律进行解释:针时我国司法裁判中存在的对法律解释的不当制约,提出对其解除的方法和时合理制约构建的可行途径,以期完善我国司法裁判中的法律解释.

| Abstract: | To prove the legitimacy of the administration of justice,to solve the substantive issues in cases and to remedy the parties in cases,the interpretation of abstract and generalized law is a must.In view of the improper restraints on legal interpretation existing in the administration of justice,the paper proposes methods to solve the problems and ways to construct reasonable constraints in order to perfect legal interpretation of judicial adjudication in China. |
