Reflections on the Function of Originality of Works and Its Remodeling: Based on the Dual Perspectives of Structure and Value Goals of Copyright Law

The disagreement over originality determination in copyright law stems from the cognitive bias of function of originality. Since originality can only justify the protection of works, and it has no legal significance to the determination and justification of the objects of neighboring rights, the systematic rights-categorizing function of originality cannot be interpreted as the objects of neighboring rights having no originality or low originality in contrast to works copyrighted with high originality, the function of value judgment spacious for the function of minimum creativity can be replaced by the dichotomy of thought and expression, and the standard of a certain degree of creative height is misunderstood as an evaluative term for single work protected in China, meanwhile, the method of economic analysis is neither proper nor operational. In fact, originality only has the function of describing the fact in terms of the action and the result of creation. Thus, the determination of originality should consider two factors which are the expression of ideas and the degree of creative freedom.
