法律职业的反思与重建

当前,我国的法律职业在职业理念、职业生活方式、职业伦理以及职业知识结构等诸多方面都与职业化要求相冲突,并影响着中国法治的发展。重建一种与现代法治要求相契合的法律职业共同体,已成为当代中国实现法治的关键。法律职业共同体的重建,不是一个单纯的法律知识的补充或司法资格统一考试问题,更是一种职业类型的转换和职业合法性的重塑问题,归根结底,它涉及司法权力性质从国家权力向社会权力的深刻转变。

Reflection and Reconstruction of the Law Profession

Since the establishment of new China, the law profession has been in confliction with the requirements of professionalization in professional thoughts, life style, ethics and knowledge construction, which impedes the development of China's law development. Thus, reconstructing a new law professional community, which is accommodated with the requirements of modern law has become a key point in the realization of ruling according to law in China. The reconstruction is not a simple law knowledge complement or a test for law qualification, but transformation of the profession and reshaping the professional legitimacy. In root, it involves the profound change of jurisdiction rights from state rights to social rights.
