| 摘 要： | 犯罪构成理论是近年刑法理论研究非常活跃的一块领地。针对有关这一理论的批判和争议，本文从犯罪构成概念界定，中外犯罪构成理论比较，我国犯罪构成理论特点分析等三方面，在总体上肯定我国当前的犯罪构成理论，指出这一理论符合国情。
