宪政视野下公共服务型政府的建设

公共服务型政府有三个方面内涵，第一，公共服务型政府是法治的政府。把公民的意志通过法定程序组建起来。第二，公共服务型政府的宗旨是为公民服务，以公民为中心。第三，公共服务型政府是责任型政府，通过宪法，让政府承担相应的责任，防止无政府状态，促进公共利益。我国公共服务型政府的宪政目标是建立民主政府，法治政府，有限与有为平衡的责任型政府。通过完善现行宪法，重视法治建设理念；建立多元的权力制约模式；做好政府职能定位；扩大公民权利等措施来建设公共服务型政府。

Construction of Public Service Government in a Constitutional Perspective

Public service government has three basic meanings. First, public service government is a legitimate government built according to the will of the citizens by statutory procedures. Second, public service government＇s aim is the service of citizens. Third, public service government is a responsible government under the constitution which undertakes corresponding responsibility to prevent anarchy and promote public interests. The constitutional goal of China＇s public service government is the establishment of democi＇atic government, legal government, responsible government balancing restriction and governance. We can construct public service government by （1） improving the present constitution and practicing the idea of law and order, （2） building a diversified pattern of power restriction, （3） reorienting government functions, and （4） expanding the rights of the citizens.
