| 摘 要： | 市场经济不单纯是经济制度,作为近现代社会思想的有机组成部分,它隐含着强烈的社会"正当性"的内涵.它是为了克服近代民族国家产生以来个人与国家和政治社会存在的紧张关系和潜在的分裂,而建立起来的个人与社会共同发展的现代社会的理念.市场经济及在此之上建立的经济社会的内涵决定了以人的品格为取向的法治社会的建立.

| Abstract: | Market economy is not mere economic institution. As a organic ingredient of modern social thoughts,it implies strong social propriety. It is a modern social ideal of individual and common social development established on the basis of the tense relation and discrepancy between individual,state and political society. Market economy and economic society contribute to the establishment of legal society. |
