| 摘 要： | 现行刑事诉讼法确立的复印件移送主义不仅未能达到立法目的,而且孳生了其他弊端,到了必须修改的地步。在我国,若采行诉状一本主义,存在诸多的不合理性。相反,若适用案卷移送主义并辅之案卷移送与答辩状一并移送的方式,则能满足诸多价值。

| Abstract: | Photocopyism in the code of criminal procedure regulations cannot satisfy the goal of legislation,but will produce many defects.So this way must be modified.In China,if the indictment-only doctrine is adopted,there will be a lot of irrationality.On the contrary,the way of conveyance of all dossiers,with the assistance of the rule of conveyance of all dossiers and response letters,will meet a lot of values. |
