| 摘 要： | 在TRIPS体制下,发展中国家丧失了根据本国经济成长阶段制定最合适的知识产权保护体制的自主权。严厉的知识产权保护,并不有利于发展中国家的技术追赶和自主创新能力的培养。TRIPS协定下强化中国知识产权保护是个两难选择,中国需要游走在TRIPS协定外生给定的发展路径的边缘,尽力选择与其自身内生化的发展路径相切的交汇点。

| Abstract: | Under the TRIPS Agreement,the developing countries are deprived of the autonomy to choose the optimal IPRS regime fit for the economy.Stronger intellectual property protection in developing countries is not conducive to the technology catching up or the fostering independent innovation capability.Strengthening China’s IPR protection under TRIPS is a big issue.China needs to follow the development path given by TRIPS exogenously,and tries its best to choose the tangent point with its endogenous development path.This point should be the bench mark of China’s IPR protection. |
