关于新《商标法》反向假冒规定的几点认识

我国新修正的《商标法》首次以立法的形式对商标“反向假冒”行为进行规制,这是我国新《商标法》的一大进步。但在实践中,对商标反向假冒规定有不同认识。应当正确认识商标反向假冒的性质、商标反向假冒与某些相关概念的区别、商标反向假冒的危害,并应对商标反向假冒规定加以扩张理解,这对深刻理解立法机关对商标反向假冒规制的立法本意,加强行政和司法机关对商标反向假冒行为的打击,维护市场经济秩序,保护商标权利人的合法利益,都有重要的现实意义。

Our Understang of the Provisions of Reverse Passing off in the New Trademark Law

It makes a great progress to regulate reverse passing off in the Trademark Law of the People's Republic of China. But there is different understandings about reverse passing off in practice. We should understand its nature in a right way, differentiate it from some relative definitions, recognize its serious harmfulness and interpret the provisions about reverse passing off extensively. These have important realistic meaning to deeply understand the real intentions of legislators, strengthen the hit to this illegal action, defend the order of marketing - economy and protect the rights and interests of trademark obligee.
