| 摘 要： | 公物利用关系私法化的发展已成为必然趋势,公众福祉的最大化即是公物利用私法化的终极追求和其价值所在。公共服务民营化的理论及宪法中公法——私法关系理论为公物利用关系私法化提供了理论支撑。公物利用关系私法化存在的问题在于政府公物管理权与公众公物使用权及私权的冲突。要真正实现公物利用关系私法化,必须在完善公物利用私法化规制的基础上,正确处理公物管理权与私权、公物使用权的关系。
