| 摘 要： | 从新证据的概念入手,通过对美、德、日三国相关制度的比较研究,剖析了我国现行民事诉讼举证时限制度存在的问题,并提出了3条对策,即：明确新证据的种类,限定新证据的采纳范围,废止以发现新证据为由启动再审程序。

| Abstract: | This thesis begins with explaining the concept of new evidence and analyses the problems existing in providing evidence for civil action through a comparative study of the related systems of USA, Germany and Japan and finally advances three policies as follows ： to make clear the category of new evidence, to limit the admissible range of new evidence and abolish starting retrial process with the discovery of new evidence. |
