抢劫网络虚拟财产行为的定罪分析

抢劫网络虚拟财产的现象已经进入我国刑事实践的视野,于是探讨这类新型抢劫行为的定罪问题也成了重要的理论和实践问题。以网络虚拟财产为对象的抢劫行为有发生在现实世界的和发生在网络空间的两种,这两种行为表现出一定的特殊性,但在本质上与传统抢劫行为有共通之处,因此可以依据现行刑法将抢劫网络虚拟财产的行为认定为抢劫罪。

The Convicted Thinking on the Behavior of Robbing Network Virtual Property

The phenomenon of robbing network virtual property has entered the vision of our criminal practice,and therefore the exploration into the behavior of these new robbery conviction has become an important problem in theory and practice.There are two kinds of the behavior on robbing virtual property which occurred in the real world and in cyberspace.Both kinds of behavior showed some particularity,but in general they have a lot in common with traditional robbery,so the behavior of robbing virtual property can be convicted as robbery according to the current criminal law.
