论传统司法研究的范式转型

在中国传统司法的研究中,一个颇为引人关注问题是,不少学者开始对现有的以西方司法理论为基础的研究范式进行反思和争论。究其原因,主要是因为在以西方的司法理论来解释中国问题时,由于各自背后的社会与文化的差异没有得到足够的重视,从而导致相关理论的解释力遭到人们的质疑。本文认为当代传统司法的研究正处于一个范式转型期,随着"超越西方"、"回归本土"等主张的提出,新的研究范式将有助于人们发现以往研究的缺陷,在此基础上提出新的概念、理论来推进传统司法的研究。在此背景下,本文也重新考察了"传统司法"这个概念并对其做了新的解读。

A Discussion on the Paradigm Transformation of Traditional Judicial Studies

In traditional Chinese judicial studies,a rather fetching problem is that many scholars began to reconsider and question the existing research paradigm on the base of western judicial theory.To investigate its reason,it is mainly because when to interpret Chinese problems with the western judicial theory,the social and cultural differences between China and the West were not taken seriously.Thus,the explanatory power of those theories is questioned by many scholars.This paper argues that the contemporary traditional judicial studies are in the phase of paradigm transformation.As views of "to transcend the western","return to indigen",etc,were proposed,new research paradigm will help us to find the defects of the previous researches,on which new concepts and theories will advance the traditional judicial studies.Under this background,this paper also takes a new look at the concept of "traditional justice" and makes a new interpretation.
