| 摘 要： | WTO反倾销协议虽规定"期终复审"制度,但未明确其审查标准和程序,导致WTO成员国恣意制定相关规定,从而引发众多WTO相关争端。中韩两国在"期终复审"的审查期限以及援引原审程序规定等问题上保持一致,但是在审查"倾销与损害的持续或再度发生的可能性"的标准上仍存在较大的区别。

| Abstract: | WTO Anti-dumping Agreement states expiry review system in its clause,however,unclearly standard and process of review system raise a lot of related disputes between WTO members,because they have arbitrary regulation on expiry review.China and South of Korea keep the same mechanism on term and process of expiry review;however,there still show big gaps on the standard of what the expiry of the duty would be likely to lead to continuation or recurrence of dumping and injury. |
