| 摘 要： | 传媒对司法的监督既有理论依据,又有政策与法律依据,也有现实的必要性,但二者理论上客观的矛盾性,实践中操作的不当性,使二者在一定程度上产生了冲突。然而,二者在追求最高价值与目标上又具有一致性,都是为了司法公正和社会正义。同时,言论自由与公正审判又都是宪法明确规定的宪法性原则,这是传媒与司法二者的契合点。由此出发,双方可以通过调整态度、规范行为、加强自律、制定法律等途径达到理想的平衡。

| Abstract: | Mass media are entitled to supervise the judicial organs,but the supervision is likely to result in conflict between the two sides.Anyhow they share one thing in common: both of them work for the judicial and social justice.Consequently,they can strike a proper balance between them. |
