| Abstract: | The "Characteristic Performance" theory is adopted by countries of Continental Legal Family as a popular standard to determine contracts' applicable law,and it greatly benefits the reification of principle of the most significant relationship.Most of the domestic laws and international treaties take,as contracts' applicable law,the law of the residence,habitual residence,and central administration of the characteristic performer.Henceforth,it is necessary and helpful to conduct a theoretical analysis of its foundation as well as its unique advantages. |
