| 摘 要： | :动产善意取得制度作为一项利益冲突的协调策略 ,在个人利益与社会利益的激烈冲突中 ,作出了艰难的取舍。如何通过对于该制度适用范围的妥当规定 ,合理兼顾所有权人与善意第三人的利益 ,以免引起不必要的社会震荡 ,成为理论界和实务界讨论的重心。动产善意取得制度适用范围的例外规定 ,就是兼顾所有权人与善意第三人利益的一项重要措施

| Abstract: | As a tactics to coordinate the conflict of interest, chattel acquisition in good faith makes a difficult choice between the sharp conflict of the private interest and the social interest. In order to avoid the unnecessary social unrest, it has been a core question how to take account of the interest of the ownership and the interest of the third party in good faith. Exception provision of applicable scope of chattel acquisition in good faith is an important measure to solve this question. |
