农民集体所有权是新农村建设法律保障的制度基础

集体所有权制度是新农村建设中最基础的法律保障制度,它是促进农村生产发展的基本法律制度,是农村民主政治的基础,是农村经济社会协调发展的基础,是承接国家和社会各方面支持新农村建设的制度基础,是提高农业和农村组织化的基础。在新农村建设中坚持和完善农民集体所有权,首先要完善集体所有权的主体制度建设,将农民集体所有权的主体明确为集体成员,集体成员依民主原则行使集体所有权,集体所有权以民为主体,民主是其根本原则。完善农民集体所有权的权能,要创造条件并在条件成熟时对农民集体所有权的转让和处分的权能予以完善,要将集体成员对集体土地等财产的使用权和收益权的享有依据直接系于其集体成员资格,而不再是承包合同,同时赋予集体成员对集体财产的民主管理和监督权以及保护的诉权。

The collective ownership system is the most basic legal protection system of the new countryside construction,the basic legal system of promoting the productive development of the countryside,the basis of the country's democratic politics,the basis of the coordinated development of the countryside's economy and society,the system basis of receiving supports from all walks of life and the government and the basis of improving agriculture and organizations of the countryside.To uphold and improve the peasant collective ownership in the new countryside construction,the first to do is to improve the subjective system of the collective ownership,regarding the subjects of the collective ownership as the collective members definitely who can exercise the rights of the collective ownership according to the democratic principles.The next is to create conditions and improve the right of conveyance of property and the rights of disposition when the conditions are fulfilled.The last is to owe the rights of exploitation and uses of the collective land and other properties to the qualifications of the collective members,but not to the contracts of the land,and to entitle the collective members the rights of democratic management and supervision and at the same time,protect their rights of action.
