| 摘 要： | 民办学校因资不抵债无法继续办学而被终止的,由人民法院组织清算。但由于民办教育促进法及其相关法律在民办学校破产清算问题上的规定不明确,导致司法实践中诸多问题的产生。围绕民办学校究竟有无破产能力,破产程序的申请主体、破产财产的分配顺序是什么,民办学校是否适用重整与和解程序等问题展开研究,并提出了相关的司法建议。

| Abstract: | In cases when the non-governmental schools have been ordered to cease business activities according to insolvency,people court shall appoint a liquidation task.Because both Law of Promoting Civilian-run Education and its relevant regulations are not clear,legal disputes occur frequently in judicial practices.Studies has been developed and the relative advice of judicature has been put forward surrounding the following problems:Is there bankruptcy ability for non-governmental schools,what are the body of application for insolvency proceedings and the distribution sequence of bankruptcy assets,whether reorganization and reconciliation procedure also apply to non-governmental schools,and so on. |
