论劳动报酬请求权与抗辩权

摘    要:根据劳动给付和劳动报酬给付时间的不同,劳动报酬有预付、后付和期中支付等不同给付方式。当劳动者行使劳动报酬请求权时,雇主不享有同时履行抗辩权和不安抗辩权,但是可能享有顺序履行抗辩权。对于同一期次的劳动给付请求,劳动者不享有同时履行抗辩权,但是雇主未支付前一期次的劳动报酬时,劳动者可以拒绝当期的劳动给付请求;当雇主发生财务困难以致有不能给付劳动报酬之虞时,劳动者应享有不安抗辩权。

Abstract:According to the difference in the time pointing of the remuneration payment and the labour performance,the modes of payment can be divided into advanced payment,interim payment and successive payment.When the labourer exercise the wage claim right,the employer don't have the right of concurrent performing counterargment and the unsafe right of defence,but can have the sequence right of defence.According to the labour performance claim,the labourer don't have the right of concurrent performing counterargmen...
