论劳动报酬请求权与抗辩权

根据劳动给付和劳动报酬给付时间的不同,劳动报酬有预付、后付和期中支付等不同给付方式。当劳动者行使劳动报酬请求权时,雇主不享有同时履行抗辩权和不安抗辩权,但是可能享有顺序履行抗辩权。对于同一期次的劳动给付请求,劳动者不享有同时履行抗辩权,但是雇主未支付前一期次的劳动报酬时,劳动者可以拒绝当期的劳动给付请求;当雇主发生财务困难以致有不能给付劳动报酬之虞时,劳动者应享有不安抗辩权。
