| 摘 要： | 程序思维是法官在司法过程中采用的主要的法律思维方式,但实质因素则是法律思维过程中不可避免要考虑到的;实质因素的选择功能可以作为沟通程序与实质的桥梁。在司法程序的启动、运行和结果反馈环节,实质因素的选择功能都以不同的面目出现,并且也都受到不同形式的约束。这些约束有些是法律思维的组成部分,有些是法律思维之外的法律制度,还有些则介于两者之间;只有妥善采用多种手段加以引导,才能发挥实质因素在程序思维中的积极作用。

| Abstract: | The process-based thinking is the main type of legal thinking in judicial process,but the substantive factors are unavoidable in the legal thinking.The optional function could be a bridge of communication between process and substantive.In the beginning,running,and feedback of the judicial process,the optional function of substantive factors shows different appearances and is limited by different restrictions.Some of these restrictions are parts of the legal thinking,some are the legal institutions without legal thinking,and some are between the two.For the substantive factors to be positive and effective in the process-based thinking,the factors should be guided by many kinds of means properly. |
