“草地故事”、论证性正义与中国信访出路

在中国法学研究中,中国法治建设目标的缺位,导致了诸多学术争论与制度设计缺少基本方向的指引.依据中国人的行为方式与行动逻辑,辅之以中国社会乃为“物化社会”的判定,或可认为“论证性正义”可以作为中国法治建设的基本目标.如果以论证性正义来解释中国法治建设进程中的问题,中国信访制度的出路就是一个恰当的实例.

In the study of China’s jurisprudence,the deficiency of China’s legal construction goal has led to many academic debates and the lack of basic system design guidelines.In accordance with the action logic of Chinese people,complemented by the judgment that Chinese society is the"Materialized Society",perhaps we can take"Demonstrativeness Justice"as a primary goal of China’s legal construction.If "Demonstrativeness Justice"is to be used to explain the process of China’s legal construction,China’s public complaint approach is a case in point.
