德国信用合作在我国的传播及立法技术运用

信用合作社是社员以互助互利为目的、以合作方式共同联合组成的自有、自营、自享的资金互助组织,是经济弱者按照合作制原则在金融领域的自助联合。信用合作社发源于德国,其制度经由知识分子的广泛传播和民间组织的深入实践,成为民国政府发展合作事业、挽救农村经济的基本路径。德国综合统一的《合作社法》直接影响着民国合作社立法,并构成了民国《合作社法》的蓝本。对德国信用合作社思想、制度以及立法技术在我国的传播和运用进行系统的梳理、检讨,正本清源,有助于正确认识信用合作社的本质属性,彰显信用合作社机能,完善我国合作社立法并有效落实国家惠农政策。

The Introduction and the Application of Legislative Skills of German Credit Cooperatives in China

The credit cooperative is an self-owned,self-supporting financial mutual-aid organization that generated in a collaborative way and work together for the purpose of mutual benefit,and it is also a self-association operated by weaknesses in the financial sector followed the cooperate principle.Credit cooperatives originated in Germany,via the widespread proliferation created by the intellectuals and in-depth practices carried out by non-government organizations,its system had been the basic path for the government of the Republic of China to develop cooperatives and rescue rural economy.German comprehensive "Cooperative Act" had a direct impact on the cooperative legislation of the Republic of China,constituting the blueprint of the Republic of China’s "Cooperative Law".Systematically probing the introduction and application of German cooperative ideas,systems,and legislation technology in China,can contribute to recognizing the essential attribute of credit cooperatives,so as to highlight the functions of credit cooperatives,and improve the level of our cooperative legislation and effectively implement our national agricultural policy.
