通过私法完成公共任务及其在中国的发展

中国的行政法学界尚未正式提出通过私法完成公共任务的概念 ,但是 ,从“直接的行政管理转向间接的行政管理”也多少反映出这一发展趋势的主导思想。这种发展所带来的各种法学问题是值得探讨的。因此 ,本文分析了采用私法完成公共任务的原因 ,其适用的范围和限度、所需要的外部条件和其在中国的发展现状及问题。

The Implementation of Public Tasks by Way of Private Laws and Its Development in China

There is not the concept of implementing public tasks by way of private laws in China's administration law circle yet,but people find such an obvious tendency from indirect administration to direct administration,however slight,which brings about various legal problems worth having an exploration.In this paper,the author has an analysis about the cause to implement public tasks by way of private laws,the range and limitations of its application,the external conditions it needs,its development and problems it faces in China.
