论物权客体

传统物权理论上的物即指有体物,物权客体仅指物。我国《物权法》以＂物＂的分类代替了＂物＂的界定,因未对物作准确定义,物权客体也具有了不确定性。随着科学技术与市场经济的发展,许多新生事物及现象进入交易领域,出现了物权观念的扩张,而物权客体也呈扩展之势。传统民法上的有体物并不限于有形物,尚包括自然力等无形物。物权客体并非只有物,有价证券、财产权利等皆为物权客体。
