社会法:一种经济法研究进路的反思

“社会法”说作为当前经济法理论研究中的流行观点之一,无疑具有重要地位.但反思“社会法”这种经济法的研究进路和方法,其局限性亦相当明显.从本质层面看,把经济法纳入社会法范畴存在着对其前提预设进行理论解释的困境,同时,经济法所具有的特定经济性,亦决定了它与社会法的殊异;从利益层面看,现代法的平衡理念及社会利益的模糊性、中介性和非终极性,决定了社会利益并不是经济法的本位或基石;从主体层面看,社团法律性质的多样性、社团地位的非主导性、社团利益与社会利益的非对称性,决定了社团不能成为经济法中最具特性的法律关系主体.

Social Law : Reflection on the Research Method of Economic Law

Social Law, as one of the most popular view points of current theoreti cal research of Economic Law, undoubtly has its significance while researchers failed to take it as a kind of research method and approach of Economic Law ,and failed to reconsider them. Based on this point of view, this article analyses and concludes social Law as method and approach from three respects of essence,benefit and main body , thus maks us keep a reconsiderational thought as to the significance of Economic Law and its direction of theory developing.
