摘    要:立法对于教师虐童行为存在界定模糊与刑法缺位的不足。将未造成轻伤的教师虐童等虐待行为入罪可以选择扩大虐待罪的主体与对象的方式,列举虐待儿童的行为,将虐待儿童构罪设为公诉罪名。对于教师虐童行为的有效防控,刑法的规制存在有限性,必须通过改变观念、增强权利意识、加强师资与民间组织的建设、严格执行相关部门法等综合治理的方式来进行。

Abstract:There are ambiguity and absence of relative law about teacher's children abuse. Research in crime constitution of chil- dren abuse will widen the subject and object of maltreatment. Listing the behavior of children abuse will make the crime into pub- lic prosecution. Anyhow, there are limitations in criminal regulation about children abuse. In order to get effective prevention and control, we should change the viewpoint, strengthen right consciousness, improve the construction of teacher' s group and civil organization, and get strict implementation of department law.
