90年代以来 ,中国大陆与台湾地区在努力谋求商标权保护制度国际化的相近背景下 ,商标权立法有不少共同点 ;同时 ,在商标注册申请人、注册商标的范畴、注册商标的原则和注册商标的在先权利、注册商标的审查与核准程序、注册商标专用权的保护等方面 ,又存在着许多差异。对两岸商标法制度 ,尤其是在上述问题上存在的差异进行比较研究 ,有助于正确认识大陆与台湾地区商标权立法的现状 ,藉以增进相互了解 ,彼此借鉴 ,进一步推进两岸商标权立法的国际化及其完善

A Comparative Study on Issues of Trademark Legislations of Both Sides Across the Strait——Comments on the Improvement and Internationalization of Trademark Legislations of Both the Taiwan Area and Mainland China

Since 1990s, both Taiwan Area and Mainland China have been striving for the internationalization of their trademark legislations. In spite of the similarities, there are lots of differences in such aspects as the applicants and the category of trademarks, the principle and priority of trademark legislation, its examination and approving process as well as the protection of the exclusive right to use trademarks. Focusing on the differences, this paper compares the trademark legislation systems across the Strait and provides an objective view of current situations in Taiwan Area and the Mainland for the purpose of better understanding and mutual improvement of both sides, which will definitely promote the internationalization of trademark legislations of both the Taiwan Area and Mainland China.
