国内创新主体对美专利审批状况分析——以中石化为例

摘    要:以国民待遇原则为出发点,对我国企业对外专利审批现状进行研究。选取具有领域代表性的创新主体中石化,对其在美申请以申请年份归类,对比研究其对美申请与同领域竞争对手以及该领域的平均审批周期、审查状态与结果、法条的应用等,比较我国创新主体对美审批过程中与竞争对手之间存在的差异,并对产生该差异可能的原因进行分析,为我国创新主体对外专利申请提供参考信息和建议。

Abstract:This paper, with the principle of national treatment as the starting point, conducts a research toward the present situation of Chinese enterprises' foreign patent examination. Selecting Sinopec the field representative innovation subject, it classifies its applications in the Unit- ed States according to the application year, makes a comparative study toward its application to the United States and the competitors in the same field, as well as the average approval period in this field, examination state and results, and the application of articles of law, compares the differences between China's innovation subjects in approval process to the United States and the competitors, analyzes the causes of the differences, so as to provide reference information and recommendations for China's innovation subjects' foreign patent application.
