亲子关系确认制度的反思与重构——基于婚姻法司法解释（三）的讨论

亲子关系的确认是亲子法的基本问题。在传统法中,它由婚生子女的推定与否认、非婚生子女的认领与准正组成。当代亲子法以子女为本位,对子女不再作＂婚生＂与＂非婚生＂区分。未成年子女最佳利益和兼顾亲子关系真实性与稳定性,成为亲子关系确认的基本原则。统一的亲子关系确认制度由亲子关系的推定、亲子关系的否认、子女的认领构成。婚姻法司法解释应对有关子女否认和认领的实体法规则作出解释。
