| 摘 要： | 犯罪期待可能性是大陆法系规范责任理论的核心,我国目前由于类似许霆等案件的出现,再次引起了对犯罪期待可能性理论的关注。从犯罪期待可能性的蕴涵、犯罪期待可能性在我国刑法中的地位、犯罪期待可能性的判断标准等方面进行梳理,希望通过探讨能对该理论研究有所帮助。

| Abstract: | criminal expected possibility is the core of Continental Legal System's legal regulations.The theory of criminal expected possibility once again captures our attention in China because of the law cases like the Xu Ting case.This paper intends to discourse it in terms of the implication of criminal expected possibility,its status in Chinese criminal law,the justifications of it.This attempt may contribute to the theoretical research of this theory. |
