台湾土地征收制度及其对大陆的启示

中国大陆当前由政府主导的大规模的征地拆迁引发了大量的矛盾和问题,成为当前社会治理的一大难点.我国台湾地区大规模的土地征收比大陆要早,而且已经较好地解决了这些问题.借鉴台湾的土地征收制度,大陆现行的土地征收制度应该在以下方面进行改革:完善土地征收程序,土地征收应向申请用地单位、被征收土地相关人和社会公开;改革土地征收补偿制度,全面、合理地计算补偿项目和补偿费用;加强土地征收的法律和制度建设,并保障农民在土地征收过程中的参与程度.

Taiwan Land Acquisition System and its Enlightenment to Mainland China

Today, the large-scale government-led land acquisition in Mainland China has caused a lot of contradictions and problems and become a tough issue in the social governance. On the contrary, Taiwan has achieved a better solution to these problems. Taiwan＇s experiences can be inspired our land acquisition system reform in the following aspects：improving the land acquisition procedure by opening the informa- tion to the land acquisition applicants, expropriated land owners and the public; reforming the land acquisition compensation system by calculating the compensation entries and costs;strengthening the legal and institutional construction of land acquisition by protecting farmers＇ participation in the process of land acquisition.
