| 摘 要： | 我国现行有关法规中规定了公安机关在对公安行政管理过程中涉及的当事人之间的民事纠纷可以进行调解，在司法实践中，某些民事赔偿纠纷起诉到法院，则又必须经过机关的行政调解，否则，人民法院不予受理。公安行政调解有其存在的必要，有其自身的特点，但是，我国关于公安行政调解的立法却不统一、不完善。公安行政调解活动在实践中也存在着很多问题，急需解决。我国应当加强公安行政调解的立法，加强对公安行政调解的监督。
