| 摘 要： | 《中华人民共和国国家赔偿法》已于１９９４年５月１２日由第八届全国人民代表大会常务委员会第七次会议通过,自１９９５年１月１日起施行。这部法律文件的颁布及实施是我国政治和法律制度建设中的一件大事,符合社会主义法制＂有法可依＂的基本要求,标志着我国立法进一步完善。它为保障公民、法人和其他组织享有依法取得国家赔偿的权利,促进国家行政机关和司法机关依法行使职权,提供法律依据。因此学习并掌握该法有着十分重要的意义。本文就其中的主要内容阐明作者的理解和认识。

| Abstract: | The Compensation Law of the People's Republic of China was passed on 12 May,1994 by the 7th Conference of the Standing Committee of the 8th National People's Congress and has been in force from 1 January,1995.The promulgation and implementation of this law is an important thing in the establishment of the political system and legal system of our country.It confirms with the basic requiement of the socialist legal system that"There are laws to follow"and symbolizes a further improvement in the legislation of our country.It provides a legal basis for guaranteeing citizens,legal persons and other organization'legal rights of national compensation,promoting the state administrative organs and judicial departments to exercise their functions and powers according to the law.therefore,it is of great significance to study and grasp the law. |
