| 摘 要： | "契约"就是特殊意志与特殊意志在平等的基础上通过协商形成的"共同的意志",即"合意"。契约"共同意志"作用方向的非固定性和非对向性使得契约与"合同"相区分。契约与人类共始终。契约缺席而形成的社会"自然状态"与个体"自然状态"实际上是"战争状态",个体与整体面临着生存与发展危机,伦理状况堪忧。契约通过自身蕴涵的自由、平等、公平等价值使个体和社会过上一种合乎人类本性的德性生活,社会整体伦理境界的提高将充满希望,实现个体至善与社会至善的有机统一也将指日可待。
