| 摘 要： | 对网络传播权的限制本质上属于对著作权的限制,而合理使用则是著作权限制的核心内容,它同样适用于网络传播权的限制。虽然对网络传播权的偏高保护使合理使用的范围呈现不断缩小的趋势,但是在网络传播中合理使用仍然有必要存在,关键在于要结合网络传播的特点,对原有的合理使用的判断标准和适用范围作相应的调整。

| Abstract: | In essence,the limitation of the network spread's right belongs to authority limitation,to which rational use is the core,and it also adapts to the limitation of the network spread's right.Although the excess protection of network spread's right makes the range of rational use take on a shrinking trend,reasonable use of the limitation in the network spread is essential.Taking the distinction of the network spread into account,implementing corresponding adjustment for the standard and range of rational use is the key. |
