| 摘 要： | 现代商人法是在中世纪的商人法基础上发展起来的,它在国际仲裁中越来越得到广泛的应用并发挥着极其重要的作用。现人商人法的统一性、国际商事仲裁的便利性以及当事人的意思自治是现代商人法适用的理论基础,各国国内立法、国际公约是现代商人法适用的立法实践。只有严格遵守“意思自治”原则,直接规定现代商人法等法律规则在国际商事仲裁中的适用顺序,在具体纠纷中慎重选择,才能加强和完善国际商事仲裁中现代商人法的适用。

| Abstract: | Modern Lex Mercotoria,developed on the basis of lex merchant theory in Middle Ages,plays an increasingly important role in the international business arbitration.The use of Modern Lex Mercotoria in international business arbitration is described from aspects of theories,legislation and practices.In addition,some speculative ideas about how to strengthen the application of Modern Lex Mercotoria and ascertain a concrete criterion are also given. |
