迈向人权的积极城市权利

积极城市权利能够使市民平等的参与城市社会空间的生产和再生产，积极构建公正的城市空间，也产生出服从城市空间管制的道德义务。积极城市权利能通过“威尔曼公式”的检测，它是以道德理由为基础，至少包含了五种霍菲尔德状态的权利体系，应该将其视为真正的道德权利。积极城市权利也是最为基础和重要的权利类别——人权，是人的能动性与自治性的实现。要实现这项人权，就要从道德领域转向法律领域进行保护，同时不同于道德权利，法律规定的积极城市权利需要接受一定的限制。
