基因专利的法律保护问题探析

基因工程技术诞生至今,基因及其技术广泛应用于农业,制药,医学,能源,环保等领域,给人们生活带来深刻的改变令人始料未及,并由此产生了的巨大经济效益和社会效应。基于基因在现在社会生活中的重要性,现从基因在知识产权领域进行保护的必要性出发,针对基因所具备的专利权的＂三性＂进行分析,在专利法上应对基因进行保护,并对完善我国基因立法提出建议。

Probe into the Issue on the Legal Protection of Gene Patent

From the moment when the genetic engineering techniques were born to the present,genes and the related technology are widely used in the fields of agriculture,pharmacy,medicine,energy,environmental protection,and the like,and have brought tremendous changes unexpected before to the people＇s life and created tremendous economic and social effects.Given the importance of genes in the present society,the present paper is to start from the necessity of protecting gene patent in the field of intellectual property rights to the analysis of the ＂three properties＂ of gene patent,so as to establish the view that gene should be protected legally.Finally,the paper puts forward a few suggestions on how to legalize gene protection in China.
