公共秩序构建中的私权保护与“电子眼”的立法规则

本文针对视频图像信息系统的地方行政立法个案，探讨公共安全领域立法的一般性规律，指出在宪政秩序内，一项公共权力及其能力的衍生与扩张应注意平衡公权与私权的宪法关系；确立实体法律授权——基本权利制约——权力制衡机制——程序控制装置——责任追究与权利救济渠道的宪政控权逻辑链条来确立相关公共权力立法的基本内容。

Individual Rights Protection in Public Order Construction and the Legislative Rules of "Electronic Eyes"

Based on the cases of local executive legislature in video image information systems, this paper explores the general principles of legislation in the field of public safety. Moreover, this paper points out, within the constitutional order, the public power and its derivatives and expansion should balance the constitutional relationship between public power and private rights; establishing the entity authorized by law-restricting fundamental rights-establishing system of checks and balances-establishing program control device-establishing accountability and rights relief channels, such a logic chain of constitutional control of power is used to establish the basic content of a public power-related legislation.
