| 摘 要： | 从中国第一个奴隶制国家夏朝到清末,中国古代的立法经历了4000多年的演进历程。这个演进过程并不是单向的而是多维的。若从国家性质上考察,它经历了由奴隶制立法到封建制立法的进步;从礼法关系上考察,它体现为礼法合一的刑的时代、法胜礼衰的法的时代和礼法融合的律的时代;从立法技术上考察,它表现为律注结合、律疏结合、律例结合三个发展阶段。正是这种多向度的发展演进的交织与融合才使得中国古代立法文化的发展历久弥新,充满活力。

| Abstract: | It is more than 4000 years for Chinese ancient lawmaking evolves from the first slave system state Xia dynasty to the last feudalism system state Qing dynasty. This process is multi - dimensions not single dimension. It is a progress from slave system legislation to feudalism system legislation basing state characteristic; Its evolves included XING ages,LAW ages and LV ages basing investigate the relation between rite and law;Its evolves experience three periods of LVZHU combination, LVSHU combination and LVLI combination basing lawmaking technical. It is slich multi - dimensions evolves that keeping Chinese ancient lawmaking vitality and develop. |
