行政立法原则新论

立法原则是行政立法理论与实践中的一个十分重要但却被学界长期忽视的问题.虽然在一些相关论著中或多或少对行政立法原则有所涉及,但鲜见深入的研究.迄今为止,学界关于行政立法原则的理解,多与一般立法原则、行政法基本原则甚至政治原则等相混同,并未能揭示出行政立法所应当遵循的特殊原则.通过分析学界在行政立法原则问题认识上所存在的不足,指出我国行政立法应当遵循三个层次的立法原则所组成的原则体系,其中广义行政立法应当遵循行政主体与相对人权利(力)义务均衡配置、尊重行政活动科学规律、实体规范与程序规范并重等三项特有原则,狭义行政立法应当遵循法律保留、审慎立法、重在执行等三项特有原则.
