| 摘 要： | 战争罪的发展演变过程交织着众多复杂的国际法理论和司法实践问题.同时由于战争犯罪是现代国际法确认的国际罪行之一,对战争犯罪行为的确认和惩处是国际法和国际社会广为关注的重要问题,因此深入研究战争罪内涵及其他相关问题,并从这个角度进一步完善惩治战争罪的原则和制度,对于发展战争罪理论体系,彻底、有效、公正地追究战争罪刑事责任,实现惩治战争罪的目的有重要意义.笔者提出了战争罪内涵及相关问题的对策建议,力争做到维护我国利益与促进国际法发展和建立公正的国际法秩序的统一.

| Abstract: | War crime,whose connotation involves various sophisticated theories of international law and practices in jurisdiction,is an increasingly important issue in the modern world in terms of the confirmation of the crime and the punishment of war criminals,and thus deserves close attention from legal workers and scholars.Such a study is of great significance in the effective and just implementation of international law and the indictment of war criminals. |
